1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your use of the Cindertick website and watch repair services. By accessing our website or engaging our services, you agree to be bound by these Terms.
"We," "us," or "our" refers to Cindertick, a watch repair service operating at 28 Jalan Stesen Sentral, 50470 Kuala Lumpur, Malaysia. "You" or "Client" refers to the individual or entity using our services.
If you do not agree to these Terms, please do not use our website or services.
2. Definitions
- "Services" means watch repair, maintenance, and conservation services provided by Cindertick
- "Timepiece" means any watch, clock, or horological device submitted for service
- "Assessment" means the initial examination and quotation process
- "Service Agreement" means the acceptance of a quotation for specific repair work
- "Website" means the Cindertick website accessible at cinderopmy.info
3. Service Description
Cindertick provides specialist watch repair and conservation services including but not limited to:
- Mainspring replacement and barrel servicing
- Museum-grade conservation for historical timepieces
- Crown and pusher replacement
- Movement servicing and restoration
- Parts fabrication and sourcing
- Timing and regulation services
Service availability may vary based on parts availability, timepiece condition, and technical feasibility. We reserve the right to decline service if:
- The timepiece requires skills or equipment beyond our capability
- Repair costs would exceed reasonable value
- Parts are unavailable and cannot be fabricated
- The client declines to provide necessary information or authorization
4. Assessment and Quotation
Upon receiving your timepiece, we will:
- Conduct a thorough assessment of condition and repair needs
- Provide a written quotation including scope of work, estimated cost, and timeline
- Await your approval before proceeding with repair work
Assessment fees may apply for complex evaluations and will be communicated in advance. Assessment fees are non-refundable but may be credited toward repair costs if you proceed with service.
Quotations are valid for 30 days from the date of issue. Prices may be subject to adjustment if parts costs change or additional work becomes necessary during repair.
5. Client Responsibilities
When using our services, you agree to:
- Provide accurate information about your timepiece and its history
- Disclose any previous repairs or modifications
- Respond to communications regarding your service in a timely manner
- Collect your timepiece within 30 days of completion notification
- Pay all invoices within agreed timeframes
- Verify ownership of the timepiece or provide appropriate authorization
6. Payment Terms
Payment Methods: We accept cash, bank transfer, and approved credit cards. Payment is due upon collection of your timepiece unless alternative arrangements have been agreed in writing.
Pricing: All prices are quoted in Malaysian Ringgit (MYR) and include applicable taxes. Prices do not include parts costs unless specifically stated in the quotation.
Deposits: For extensive repairs or conservation projects, we may require a deposit of up to 50% before commencing work.
Late Payment: Timepieces not collected within 30 days of completion may incur storage fees. After 90 days, we reserve the right to dispose of uncollected timepieces in accordance with Malaysian law.
7. Service Warranty and Limitations
Warranty Coverage: Work performed by Cindertick is warranted against defects in workmanship for a period of 12 months from the date of service completion. This warranty covers:
- Failure of replaced parts
- Defects in repair work performed
- Timing errors resulting from our service
Warranty Exclusions: The warranty does not cover:
- Normal wear and tear
- Damage from misuse, accident, or unauthorized repairs
- Components not replaced during service
- Water damage if seals were not specifically replaced
- Damage from magnetic fields, shock, or environmental factors
- Cosmetic issues not related to our work
To claim warranty service, you must provide proof of service and the timepiece must not have been opened or repaired by others.
8. Disclaimers
Watch repair involves inherent risks. While we exercise appropriate care and skill, we cannot accept responsibility for:
- Pre-existing damage or wear not discovered during assessment
- Failure of components not included in the agreed service scope
- Deterioration of fragile or aged materials during necessary service procedures
- Value fluctuations of your timepiece
- Sentimental value
No Guarantee of Specific Results: We provide professional watch repair services but cannot guarantee specific outcomes such as exact timing accuracy, parts availability, or restoration to original condition.
Services are provided "as is" to the extent permitted by Malaysian law. We make no warranties beyond those explicitly stated in these Terms.
9. Limitation of Liability
To the maximum extent permitted by Malaysian law, our liability for any claim arising from our services is limited to the lesser of:
- The amount paid for the specific service giving rise to the claim, or
- MYR 5,000
We are not liable for:
- Indirect, consequential, or incidental damages
- Loss of use, revenue, or profit
- Emotional distress or sentimental loss
- Damage to reputation
10. Care and Storage of Timepieces
We maintain secure storage for timepieces in our care. However, clients are advised that:
- We cannot accept responsibility for loss or damage from events beyond reasonable control (fire, flood, theft, etc.)
- Insurance coverage of timepieces in our possession is limited
- Clients should maintain their own insurance for valuable timepieces
- We will take reasonable care but cannot guarantee absolute security
For timepieces of significant value (exceeding MYR 10,000), clients are strongly advised to arrange separate insurance coverage.
11. Intellectual Property
All content on the Cindertick website, including text, graphics, logos, and images, is the property of Cindertick and protected by Malaysian copyright law.
You may not reproduce, distribute, or create derivative works from our website content without written permission.
12. Privacy and Data Protection
Collection and use of your personal information is governed by our Privacy Policy, which complies with the Personal Data Protection Act 2010 of Malaysia.
By using our services, you consent to data collection and processing as described in our Privacy Policy.
13. Service Cancellation and Termination
Client Cancellation: You may cancel service before work commences without penalty. If work has begun, you will be charged for work completed and parts ordered.
Our Right to Terminate: We reserve the right to refuse or discontinue service if:
- Payment terms are not met
- You provide false or misleading information
- You act in a threatening or abusive manner toward staff
- Continuing service becomes impractical or unfeasible
14. Dispute Resolution
Informal Resolution: In the event of any dispute, we encourage clients to contact us directly to seek resolution. Most issues can be resolved through good faith discussion.
Governing Law: These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
Mediation: Before initiating legal proceedings, both parties agree to attempt mediation through a mutually agreed mediator.
15. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cindertick regarding our services.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force.
Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations to a successor business.
Force Majeure: We are not liable for delays or failures to perform due to circumstances beyond reasonable control.
16. Changes to These Terms
We may modify these Terms from time to time. Changes will be posted on this page with an updated effective date. Material changes will be communicated to active clients via email or notification upon service collection.
Continued use of our services after changes constitutes acceptance of modified Terms.
